How Can a Company Ensure Its AI Systems Comply with AI Regulation?

Step 1: Inventory (Know What You're Running)
You cannot comply with regulations you haven't mapped to your actual AI deployments. Start with a complete inventory:

Step 2: Classify (Determine Your Obligations)
Two classification exercises run in parallel:
A. Deployer type. Your deployer type determines which laws apply:
- Private sector → TRAIGA only
- Government agency → TRAIGA + SB 1964 + HB 3512
- Healthcare provider → TRAIGA + SB 1188
B. Prohibited practice screening. Each AI system is screened against TRAIGA's 7 prohibited practices. Pass/fail on each. If any system fails, it must be modified or decommissioned before you can achieve compliance.
Step 3: Assess (Measure Your Risk)
Conduct a risk assessment for each AI system, aligned to the NIST AI RMF Map and Measure functions:
- Map — Identify and contextualize risks specific to each system. Who is affected? What could go wrong? What are the downstream consequences?
- Measure — Quantify risks with metrics. Bias testing across demographic groups. Accuracy benchmarks. False positive/negative rates. Confidence thresholds.
For government agencies, AI systems in critical decision categories (parole, child welfare, employment, benefits, law enforcement) require the heightened scrutiny assessment mandated by SB 1964.
Step 4: Document (Build Your Defense)
Documentation is where most companies fail. They do the work but don't produce the artifacts that prove it. Under TRAIGA, your NIST alignment is only as strong as your evidence:
- AI governance policy — Roles, accountability, acceptable use, prohibited practices, review cadence
- Risk assessment reports — Per-system documentation of risks identified, metrics measured, and controls implemented
- Control mappings — How your governance processes map to NIST AI RMF subcategories
- Evidence bundles — Timestamped compliance packages that demonstrate your governance posture at a specific point in time

Step 5: Monitor (Detect Drift Before Regulators Do)
AI systems change. Models are updated. Data distributions shift. New edge cases emerge. Your compliance posture from January is not valid in December unless you're monitoring:

- Bias monitoring — Has output drift introduced disparate impact across protected classes?

- Incident logging — Are failures, complaints, and anomalies being captured and tracked?
This maps to the NIST Manage function. Without it, your compliance posture degrades in real time.
Step 6: Respond (Handle Violations Before They Escalate)

- Internal escalation triggers (who is notified, how quickly)
- Investigation and root cause analysis process
- Cure plan development (what changes, in what order)

- Consumer harm assessment (cure only works if no harm persists)
Step 7: Prove (Generate Evidence on Demand)
Compliance without evidence is just opinion. When the Texas AG comes knocking, you need to produce:
- Your AI governance policy (dated, versioned, approved)
- Your AI system inventory (complete, current)
- Prohibited practice screening results for each system
- Risk assessment documentation for each system
- NIST AI RMF control mapping with evidence of implementation
- Monitoring logs showing continuous oversight
- Incident response records (if applicable)
This is the evidence bundle. It's not a one-time deliverable — it's a living archive that should be regenerable at any point in time.
