Texas AI Law for Employers: Workforce Compliance Under TRAIGA

Texas enacted new law for employers using artificial intelligence — and most employers haven't caught up yet. The Responsible Artificial Intelligence Governance Act (TRAIGA) creates specific compliance obligations for any employer using AI in hiring, HR, workforce management, or employee monitoring in Texas.

This guide covers every employment-specific AI compliance requirement under TRAIGA, the prohibited practices most likely to affect employers, and the practical steps to build your defense.

AI Tools That Make You a Deployer Under TRAIGA

If your organization uses any of these AI-powered tools for Texas-based employees or candidates, you are a deployer under TRAIGA:

The key word is awareness. If the employee knows the AI is influencing their choices and how, it's likely compliant. If the influence mechanism is hidden, it's likely prohibited.

3. Vulnerability Exploitation

AI systems that target cognitive, physical, or economic vulnerabilities to distort behavior are prohibited. In the employment context, this could include:

  • Scheduling algorithms that exploit workers' economic dependence (knowing they can't refuse shifts) to assign undesirable schedules
  • AI that targets employees with disabilities or health conditions for differential treatment
  • Systems that use financial stress data to influence compensation negotiations

The NIST Safe Harbor for Employers

  • Govern: Who in your organization is accountable for AI governance in HR? Is there a policy that covers AI use in employment decisions?

  • Measure: How do you evaluate whether your AI hiring tools are producing fair outcomes? Are you testing for disparate impact?
  • Manage: When an AI system produces a questionable result, what is the escalation path? How are incidents logged and remediated?

Government Employers: Additional Obligations

Texas government employers face triple compliance:

  • TRAIGA: All prohibited practice screening + NIST alignment (same as private sector)
  • SB 1964: If your agency uses AI in employment decisions (hiring, promotion, termination), those systems require heightened scrutiny assessments before deployment — documented accuracy, bias risk, human oversight mechanisms
  • HB 3512: Annual DIR-certified AI training for all state employees using computers 25%+ of their duties

A government agency using AI in hiring must screen the system under TRAIGA, conduct a heightened scrutiny assessment under SB 1964, publish the system in their public AI inventory, and ensure relevant HR staff have completed HB 3512 training.

The Employer Compliance Checklist
